RESOLUTION NO. 6760

This pertains to the Memorandum dated 29 April 2004 of Commissioner Florentino A. Tuason, Jr., Commissioner-In-Charge, Law Department, relative to the Memorandum of the Law Department recommending to include Abaypamilya Foundation, Incorporated in the list of party-list participants in the forthcoming May 10, 2004 National and Local Elections, in view of the status quo order issued by the Supreme Court in G.R. 162362.

The Memorandum of Commissioner Tuason reads:

"Forwarded for consideration of the Commission en banc is the attached Memorandum of the Law Department recommending to include Abaypamilya Foundation, Incorporated in the list of party-list participants in the forthcoming May 10, 2004 National and Local Elections, in view of the status quo order issued by the Supreme Court in G.R. 162362."

The Memorandum of Atty. Dalaig reads:

"This pertains to the Resolution dated April 2, 2004 of the Supreme Court En Banc in G.R. No. 162362 entitled Abaypamilya Foundation Inc. versus Commission on Elections which reads as follows:

'The Court Resolved to

1. NOTE the Comment on the Petition dated 30 March 2004 filed by the Office of the Solicitor General for public respondent in compliance with the resolution of 23 March 2004;
2. REQUIRE the petitioner to file REPLY to the above Comment within ten (10) days from notice hereof; and
3. REQUIRE the parties to observe the STATUS QUO prevailing before the filing of the petition.'

In view whereof, the Law Department RECOMMENDS to include ABAYPAMILYA FOUNDATION INC. in the Certified List of Political/Sectoral parties, Organizations/Coalitions that will participate in the May 10, 2004 party-list elections."

Considering the foregoing, the Commission RESOLVED, as it hereby RESOLVES, to APPROVE the recommendation the Law Department to include ABAYPAMILYA FOUNDATION INC. in the Certified List of Political/Sectoral Parties, Oranizations/Coalitions that will participate in the May 10, 2004 party-list elections.

Let the Law Department implement this resolution.
